This website is owned and operated by TKS The Keepsakesshop. These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website lists holiday keepsakes for sale.  By accessing or using the website, you approve that you have read, understood, and agree to be bound by these terms.

Who can use our website? What are the requirements?

When using our website, you must be of the legal age of majority in your jurisdiction and possess the legal authority, right, and freedom to enter into these terms as a binding agreement. You are not allowed to use this website if doing so is prohibited in your country or under any law or regulation applicable to you. Our products are to be used as intended and should not be used for any unauthorized purpose. 

Terms Offered to Customers

When buying an item, you agree that: (i) you are responsible for reading the item listing in full before making a commitment to buy it; (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

Our products are available exclusively online via our website.  Some of our products are limited edition items crafted exclusively for our store, and some are offered in limited quantities.  Due to the handmade nature of our products, no two are alike and variations will be present.

We have the right to refuse an order at our sole discretion if circumstances deem it appropriate.  We may limit quantities purchased per order if it appears in our judgment to be placed by dealers for resale.

We may permanently or temporarily terminate or suspend access to our services without notice and liability for any reason or at our discretion.  You must receive written permission before you can duplicate, copy, sell, or resell our services/products. 

Warranties & Responsibilities for Services and Products

When we receive a valid claim under the guidelines of our return policy for product replacement, the replacement will be processed. If we cannot replace the product as noted in our return policy, the customer will be entitled to a full refund upon receipt of the returned product. We will pay for the shipment of the replacement products to the customer, and the customer will be responsible for the return shipment of the product being replaced.

Ownership of intellectual property, copyrights and logos

All users will recognize and agree that before downloading any copyright/trademark content from the website (including, but not limited to designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, and literary works) that they have obtained written permission from the owner of those contents.

Right to suspend or cancel user accounts/access

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason. This includes if we have determined you have violated any provision of these terms or any applicable law or regulations. Violation of these terms may result in your discontinued access to our site/products/services.

You agree to indemnify and hold TKS The Keepsakesshop and its owner harmless from any demands, loss, liability, claims, or expenses (including attorneys’ fees) made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

To the maximum extent permitted by applicable law, TKS The Keepsakesshop and its owner assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers/any and all personal information stored therein.

We reserve the right to modify these terms at our sole discretion. Therefore, you should review the terms periodically. When we change the terms in a material manner, we will notify you that material changes have been made to the Terms. Your continued use of the website after any such change constitutes your acceptance of the new terms.
